per Department for Health v IC and Lewis [2015] UKUT 159 (AAC) at [107] that the passages cited above (in BUAV) are not concerned with s. 3(2)(b) FOIA directly. Nevertheless, in the Commissioner’s submission the approach of applying a broad interpretation is as applicable to s. 3(2)(b) as it is to s. 3(2)(b) (and BUAV is commonly cited before tribunals in the context of appeals raising s. 3(2)(b) issues: see e.g. Visser v IC and Southwark Borough Council (EA/2012/0125) (“Visser”) at [27] and Ryan v IC and Wye Valley Trust (EA/2016/0125) at [36]).
