Information Commissioner Sent Highways England Complaint

The ICO has been presented a complaint relating to Highways England’s failure to provide information about sub-threshold claims; demands for payments from drivers, fleets and insurers which (usually) fall below £10,000 and in respect of which the contractor is not paid by Highways England but must recover the monies … or stand the loss.

In response to Freedom of Information requests during 2015 & 2016, Highways England repeatedly stated they hold no sub-threshold claim information yet, following written statements from a  contractor, evidence given at Court by a contractor in the name of Highways England and a 2017 FoIA request, it transpires Highways England are provided a great deal of information about every sub-threshold claim.
