Are Highways England Competent?

26/04/2018 – Highways England response to an FoIA request about Appendix A – FOI CRS 750 957 Appendix A

  • Question: Area 1 3 6 8 9 13 – is Appendix A is used in the numbered areas?
  • Answer: Appendix A to Annex 23 is not applied to contracts used for these Areas with the exception of Area 9 ASC.

Or to put it another way, Appendix A to Annex 23 is not used in Areas 1, 3, 6, 8 and 13.


However, this is contradicted by the following:

01/11/2017 – Response from Highways England: Appendix A of Annex 23 (Ref: 18471780/753,599):

To confirm, Annex 23 applies only to the following remaining ASC contracts: Areas 3, 4, 6, 8, 9, 10 & 12.

Appendix A only forms part of Annex 23 in the following contracts:
• Areas 4 & 12 – where the service provider is A-one+.
• Areas 6, 8 & 9 – where the service provider is Kier.
For the above five contracts, the appropriate Highways England contract performance teams have confirmed that they are content that their service providers have been and are acting in accordance with Annex 23 and the principles as outlined in Appendix A.

06/04/2016 – FoIA request re Kier Highways Charging Methodologies.

Within the response is the following:

Q: What increases in charges have been agreed year on year?
A: In accordance with the contracts, the prices are adjusted by the contract price
adjustment for inflation on an annual basis.

Really? Between 04/2015 & 09/2016 AIW’s charged to Highways England in Area 9 saw a reduction in their hourly rate from £22.73 to £20.19. Other members of Kier Highways staff also saw the rates to Highways England reduce:
£22.73 to £12.63
£20.19 to £12.77
£45.04 to £40
£45.04 to £40
£29.28 to £26

Who is providing an accurate account, why are there contradictions, why is it necessary for us to highlight the issue and what faith can you place in responses form Highways England?
